Terms of Service
1. Acceptance of Terms
By downloading, installing, accessing, or using the LOST — Last One Standing Tournament mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Veygos Productions LLC, a Utah limited liability company (“Company,” “we,” “us,” or “our”). If you do not agree to these Terms, do not download, install, or use the App.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the “Effective Date” above. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms.
2. Eligibility
2.1 Paid Tournaments
You must be at least eighteen (18) years of age to participate in any paid tournament. Identity verification via Stripe Identity (Know Your Customer, or “KYC”) is required before entering any paid tournament. You must provide a valid government-issued photo ID and any additional verification information we request.
2.2 Free, Points-Only Mode
You must be at least thirteen (13) years of age to use the App in free, points-only mode. Users under 13 are not permitted to create an account, in compliance with the Children’s Online Privacy Protection Act (COPPA). Age is self-declared during account creation via date of birth. We reserve the right to require age verification at any time and to suspend or terminate any account for which age cannot be reasonably substantiated.
2.3 Geographic Restrictions
Paid tournaments are currently available only in the State of Utah. The App uses GPS-based geofencing to verify your location. Users outside Utah may access the App in free, points-only mode. We may expand paid tournament availability to additional jurisdictions in the future, subject to applicable law.
2.4 General Restrictions
You may not use the App if you are prohibited from doing so under applicable law, have been previously banned from the App, or are located in a jurisdiction where your use of the App would violate any applicable law or regulation.
3. Account Registration and Security
3.1 Account Creation
You must create an account to use the App. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 One Account Per Person
Each individual may maintain only one (1) account. Creating or operating multiple accounts (“multi-accounting”) is prohibited and constitutes grounds for immediate and permanent ban of all associated accounts, forfeiture of any pending prizes, and disqualification from all active tournaments.
4. Gameplay Mechanics
4.1 Overview
LOST is a real-world augmented reality (AR) elimination game. Players physically navigate real-world environments using GPS and an AR camera interface to locate and eliminate assigned targets. The game uses a circular elimination structure: each player is assigned one target, forming a continuous ring. When you eliminate your target, you inherit their target. The last player standing wins.
4.2 Eliminations
To eliminate your assigned target, you must achieve GPS proximity to the target and confirm the elimination via the AR camera interface. There are no random number generators, dice, cards, or random outcome mechanics. Skill factors include physical movement and navigation, strategic pursuit timing, situational awareness, stealth and evasion, play-area knowledge, and AR camera execution.
4.3 Target Assignment
Targets are assigned in a circular chain at the start of each tournament. Assignment is randomized to ensure fairness, analogous to bracket seeding in athletic tournaments. The randomized circular assignment is the sole element of chance in gameplay; all other outcomes are determined by player skill.
4.4 Speed Threshold
For player safety, the AR interface and all elimination functionality are automatically disabled when the App detects device movement at speeds exceeding twenty-five (25) miles per hour. Players must not attempt to play the game while operating a motor vehicle or any other form of transportation that would create a safety hazard.
5. Safe Zones
5.1 Designated Safe Zones
The following locations are designated as Safe Zones within the App:
- K–12 schools and school grounds (universities and colleges are not designated safe zones)
- Hospitals and medical facilities
- Cemeteries
- Places of worship
- Government buildings
- Player-designated home base (one per account, 50-meter radius, configurable in settings)
5.2 Safe Zone Effect
When a player’s device is detected within a Safe Zone, that player becomes untargetable and untrackable by other players. The player’s location will not be visible to their assigned tracker, and no elimination can be initiated against them. Safe Zone boundaries are determined by GPS geofencing data maintained by the Company.
5.3 Abuse of Safe Zones
Intentionally exploiting Safe Zones to gain an unfair competitive advantage (e.g., remaining in a Safe Zone for prolonged periods to avoid elimination) may result in penalties, including but not limited to disqualification from the active tournament. The Company reserves the right to implement time limits or other mechanisms to prevent Safe Zone abuse.
6. Tournament Types and Prize Structures
6.1 Paid Tournaments
Paid tournaments require a fixed entry fee. Entry fees are collected via Stripe using an authorize-and-capture model. Your payment method is authorized at the time of entry, and the charge is captured only upon tournament commencement. If a tournament is cancelled before commencement, the authorization hold is automatically released. All paid tournaments feature fixed, pre-announced cash prizes disclosed prior to entry. The Company does not use in-app purchases, virtual currency, or stored balances for paid tournament entry or prize disbursement.
6.2 Prize Formats
Tournaments may use one or more of the following prize structures, which will be clearly disclosed before entry:
- LOS (Last One Standing): The entire prize is awarded to the last remaining player.
- Podium: Prizes are distributed among the top finishers, with a Last One Standing bonus.
- Bounty: Players earn a bounty for each elimination they make, with a Last One Standing bonus.
- Podium + Bounty: A combination of placement prizes, per-elimination bounties, and a Last One Standing bonus.
Specific distribution percentages for each format are published in the Tournament Rules and on each tournament listing prior to registration.
6.3 Prize Funding and Structure
Prize amounts and payout structures are fixed and disclosed in full prior to tournament entry. The Company funds all tournaments and operates them as the guarantor; the announced prize is a fixed obligation of the Company and does not vary based on the number of participants. Entry fees are not pooled to fund the prize. The Company may operate any individual tournament at a loss; this does not affect the announced prize amount.
6.4 Free, Points-Only Tournaments
Free tournaments are available to all eligible users in U.S. states. All four tournament types (LOS, Podium, Bounty, and Hybrid) are available in free mode. Free tournaments require a minimum of four (4) registered players to commence and award points only. Points have no monetary value and are not redeemable for cash. Free tournament creators may manually start a tournament once the four-player minimum is met. Free tournaments may include advertisements to support the service.
6.5 User-Created Tournaments
Any KYC-verified user located within an eligible jurisdiction may create a paid tournament. Any account holder may create a free tournament. There is no administrative fee for creating a tournament. Tournament creators select parameters within the App’s approved constraints. The Company is the operator and guarantor of every tournament, including those initiated by users, and is responsible for prize disbursement. The Company is not liable for tournament-related disputes between players arising from creator-selected parameters.
7. Payments, Prizes, and Tax Obligations
7.1 Payment Processing
All payments are processed through Stripe. Entry fees are charged via Stripe’s checkout flow, which may include Apple Pay as a payment method (Apple Pay is a wallet, not Apple In-App Purchase). By entering a paid tournament, you authorize us to charge your selected payment method for the applicable entry fee.
7.2 Prize Disbursement
Prizes are disbursed directly to winners’ bank accounts via Stripe Connect Express. To receive prize disbursements, you must complete Stripe Connect onboarding, including providing valid banking information and any required identity verification. The Company will initiate prize transfers within seven (7) business days following tournament completion and result verification, after the 48-hour anti-cheat review period described in the Tournament Rules.
7.3 Authorize and Capture
Entry fees use Stripe’s authorize-and-capture functionality. Your payment method is authorized (held) at the time of entry. The charge is captured (finalized) only when the tournament begins. If the tournament is cancelled before commencement, the authorization hold is released and you will not be charged.
7.4 Refunds
Refund eligibility is governed by the Tournament Rules. In summary: if the Company cancels a tournament for any reason (including failure to meet minimum player threshold), all entry fees are fully refunded or, where applicable, authorization holds are released. If a player voluntarily withdraws after tournament commencement, no refund is issued and the player is treated as eliminated. In the event of a material technical failure during a tournament that compromises competitive integrity, the Company may, in its sole discretion, issue partial or full refunds.
7.5 Tax Reporting
You are solely responsible for reporting and paying all applicable taxes on any prizes you receive. If your cumulative prize earnings from the App reach or exceed six hundred dollars ($600) in a calendar year, you will be required to provide a completed IRS Form W-9. The Company will issue IRS Form 1099-MISC for prize payments meeting or exceeding this threshold. Backup withholding of 24% may apply to individual payouts of $5,000 or more. Failure to provide a valid W-9 when requested may result in withholding of future prize payments and/or suspension of your account. Tax records are retained for a minimum of seven (7) years following the applicable tax year.
8. Prohibited Conduct and Anti-Cheat Policy
8.1 Zero Tolerance Policy
The Company maintains a zero-tolerance policy for cheating and prohibited conduct. Any violation of this Section 8 will result in immediate and permanent ban of your account, forfeiture of all pending prizes, disqualification from all active tournaments, and forfeiture of any entry fees for active tournaments. There is no warning system; enforcement is immediate upon detection or determination of a violation. Forfeited entry fees are retained by the Company and are not redistributed.
8.2 Prohibited Conduct
The following conduct is strictly prohibited:
- GPS Spoofing: Using any software, hardware, or technique to falsify, manipulate, or simulate your device’s GPS location.
- Jailbreaking/Rooting: Using the App on a jailbroken (iOS) or rooted (Android) device, or using any method to bypass device security or operating system integrity checks.
- Collusion: Coordinating with other players to manipulate tournament outcomes, including but not limited to arranging intentional eliminations, sharing target information outside the App, or coordinating to disadvantage other players.
- Multi-Accounting: Creating, operating, or using multiple accounts for any purpose, including entering the same tournament with more than one account.
- Automation: Using bots, scripts, macros, or any automated means to interact with the App.
- Reverse Engineering: Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code of the App.
- Exploitation: Exploiting bugs, glitches, or vulnerabilities in the App rather than reporting them to the Company.
- Interference: Interfering with or disrupting the App, servers, networks, or other players’ experiences.
- Harassment: Engaging in threatening, harassing, abusive, or intimidating behavior toward other players, whether in-person during gameplay or through usernames, avatars, or any other means.
8.3 Detection Methods
The Company employs technical measures to detect prohibited conduct, including but not limited to GPS spoofing detection, device integrity verification, behavioral analysis, and statistical anomaly detection. You agree not to circumvent or interfere with these detection systems.
8.4 Appeals
Banned users may submit one (1) appeal in writing to appeal@getlost4fun.com within thirty (30) days of the ban. The Company will review the appeal and respond within fourteen (14) business days. The Company’s decision on appeal is final and binding.
9. User-Generated Content
9.1 Content Types
The App permits user-generated content in the form of usernames and avatar images (“User Content”). The App does not currently include a chat feature.
9.2 Content Standards
User Content must not contain, depict, or reference any of the following: obscene, pornographic, or sexually explicit material; hate speech, slurs, or content that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin; threats of violence or promotion of violent acts; impersonation of other individuals or entities; personally identifiable information of any third party; intellectual property of any third party without authorization; or any content that violates applicable law.
9.3 Reporting and Enforcement
Users may report objectionable User Content through the App’s reporting feature. The Company will review reported content and take action, which may include removal of the content and/or suspension or termination of the offending account, within twenty-four (24) hours of receiving a report. The Company reserves the right to remove any User Content at any time, with or without notice, for any reason.
9.4 License Grant
By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the App.
10. Intellectual Property
The App and all associated content, features, and functionality — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the underlying code — are the exclusive property of Veygos Productions LLC or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws. “LOST,” “Last One Standing Tournament,” and all related logos and marks are trademarks of Veygos Productions LLC. You may not use, copy, reproduce, modify, distribute, or create derivative works from any portion of the App without the express written consent of the Company.
11. Privacy and Data Collection
11.1 Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy for information about how we collect, use, and share your data.
11.2 Location Data
The App requires access to your device’s GPS location services to function. By using the App, you consent to the collection, processing, and use of your real-time location data for gameplay purposes, geofencing (including Safe Zone detection and jurisdictional verification), and anti-cheat enforcement. Real-time GPS coordinates are ephemeral and are not persisted beyond the active gameplay session, except in aggregated or anonymized form as described in the Privacy Policy. You may revoke location permissions at any time through your device settings, but doing so will render the App non-functional.
11.3 Identity Verification Data
For paid tournament participants, identity verification is performed through Stripe Identity. The Company does not directly store government-issued ID images or biometric data; such data is processed and retained by Stripe in accordance with Stripe’s privacy policy.
12. Disclaimers and Assumption of Risk
12.1 Physical Activity Disclaimer

12.3 GPS Accuracy
The Company does not guarantee the accuracy of GPS data or geofencing boundaries. GPS signals are subject to interference, inaccuracy, and environmental factors beyond the Company’s control. You acknowledge that GPS-based gameplay may produce imprecise results and agree not to hold the Company liable for any issues arising from GPS inaccuracy.
12.4 Player Conduct
You are solely responsible for your conduct while using the App. You agree to obey all applicable laws, respect private property, follow all posted rules and regulations at any location you visit during gameplay, and exercise reasonable judgment regarding your personal safety. The Company is not responsible for the actions of any player or third party.
12.5 Safe Gameplay
You agree not to use the App while operating a motor vehicle, bicycle, or other vehicle; while in any situation where use of a mobile device would be unsafe or unlawful; or while trespassing on private property. You agree to remain aware of your physical surroundings at all times during gameplay.
13. Limitation of Liability
14. Indemnification
You agree to indemnify, defend, and hold harmless Veygos Productions LLC, its officers, directors, members, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your User Content; (e) any physical injury or property damage caused by your actions during gameplay; or (f) any dispute between you and another player.
15. Dispute Resolution
15.1 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App (“Dispute”) shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by this Section 15. The arbitration shall take place in Salt Lake County, Utah, unless you and the Company mutually agree to a different location. The arbitrator shall apply Utah law consistent with the Federal Arbitration Act.
15.2 Class Action Waiver
15.3 Exception for Small Claims
Notwithstanding the foregoing, either party may bring an individual action in small claims court in Salt Lake County, Utah, provided the claim falls within the court’s jurisdictional limits.
15.4 Opt-Out
You may opt out of this arbitration provision by sending written notice to opt-out@getlost4fun.com within thirty (30) days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of this arbitration clause.
15.5 Informal Resolution
Before initiating arbitration, you agree to first contact us at support@getlost4fun.com and attempt to resolve the Dispute informally for at least thirty (30) days.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted under these Terms, you and the Company agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah.
17. Termination
17.1 Termination by You
You may terminate your account at any time by contacting us at support@getlost4fun.com or through the account settings in the App. Termination of your account does not entitle you to a refund of any entry fees for tournaments that have already commenced.
17.2 Termination by Company
The Company may suspend or terminate your account at any time, with or without cause, with or without notice. In the event of termination for cause (e.g., violation of these Terms), you forfeit all pending prizes and entry fees. In the event of termination without cause, the Company will release any pending authorization holds and disburse any verified, unclaimed prizes.
17.3 Survival
Sections 7.5 (Tax Reporting), 8 (Prohibited Conduct), 9.4 (License Grant), 10 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 15 (Dispute Resolution), 16 (Governing Law), and this Section 17.3 shall survive any termination or expiration of these Terms.
18. Apple-Specific Terms (End User License Agreement)
The following terms apply to your use of the App obtained through the Apple App Store:
18.1 Acknowledgment
These Terms are between you and Veygos Productions LLC only, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content.
18.2 Scope of License
The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
18.3 Maintenance and Support
Veygos Productions LLC is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation to furnish any maintenance or support services.
18.4 Warranty
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
18.5 Product Claims
Veygos Productions LLC, not Apple, is responsible for addressing any claims relating to the App, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
18.6 Intellectual Property Claims
In the event of any third-party claim that the App or your use of the App infringes that third party’s intellectual property rights, Veygos Productions LLC, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
18.7 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy and Tournament Rules, constitute the entire agreement between you and the Company regarding your use of the App and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
19.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
19.3 Waiver
The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
19.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without the Company’s prior written consent. The Company may assign these Terms without restriction.
19.5 Notices
All legal notices to the Company should be sent to: Veygos Productions LLC at legal@getlost4fun.com. We may provide notices to you via the App, email, or other reasonable means.
19.6 Force Majeure
The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, power failures, internet failures, or third-party service provider outages.
19.7 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect.
